Dream Green Bedding – Terms & Conditions

1. Definitions

“DreamGreen Bedding”, “we”, “our”, “us” means the operator of dreamgreenbedding.com.

“Customer”, “you” means any person or entity purchasing Products from our website.

“Products” means all items and services supplied by DreamGreen Bedding.

“Contract” refers to these Terms & Conditions, any order confirmation, and invoice.

“Price” means the total amount payable, including GST, shipping, and handling fees where applicable.

2. Acceptance of Terms

By placing an order or using this website, you agree to these Terms. If these Terms conflict with any prior communication, these Terms will prevail. We may update these Terms from time to time; the version in force at the time of your order will apply.

3. Pricing & Availability

  • All prices are shown in New Zealand Dollars (NZD) or Australian Dollars (AUD), depending on your location.
  • Prices exclude Goods and Services Tax (GST) at the applicable rate (15% NZ, 10% AU). Shipping is calculated separately at checkout.
  • We reserve the right to refuse or cancel any order in the event of stock unavailability, pricing errors, or suspected fraud.

4. Payment

  • Orders must be paid in full before dispatch unless you have an approved trade account.
  • Accepted payment methods include credit card, debit card, or other methods listed at checkout.
  • If payment is not received, we may suspend or cancel your order.

5. Shipping & Delivery

  • Delivery is available throughout New Zealand and Australia.
  • Delivery timeframes are estimates only and may vary by location and product availability.
  • We are not liable for delays beyond our reasonable control (e.g., natural disasters, strikes, pandemics). However, if delivery is unreasonably delayed, you may be entitled to a remedy under the Consumer Guarantees Act (NZ) or the Australian Consumer Law (AU).
  • Handling or oversized-item fees may apply.

6. Returns & Refunds

  • Returns within 30 days of purchase for unused, unopened, and resalable Products.
  • For hygiene reasons, opened bedding (e.g., pillows, quilts, toppers) cannot be returned unless faulty.
  • If a Product is faulty, we will provide a repair, replacement, or refund as required under NZ and AU law.
  • Refunds will be processed using the same payment method used for purchase.

7. Warranty

Products carry warranties against manufacturing defects as specified on the product page. This warranty does not cover misuse, normal wear and tear, or failure to follow care instructions.

8. Liability

Nothing in these Terms excludes your rights under the CGA (NZ) or ACL (AU). To the extent permitted by law, our liability is limited to the replacement, repair, or refund of the Product purchased. We are not responsible for indirect or consequential loss (including lost profits or business interruption).

9. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, strikes, shipping delays, pandemics).

10. Governing Law

These Terms are governed by the laws of New Zealand. For Australian customers, rights under the Australian Consumer Law also apply. Disputes may be brought in Australian courts where mandatory protections require.

11. Privacy

We respect your privacy. Please refer to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our website, you consent to the practices outlined in our Privacy Policy.

12. Intellectual Property

All content on this website (including images, text, logos, and product descriptions) is owned by or licensed to DreamGreen Bedding and may not be reproduced without permission.

13. Product Descriptions & Accuracy

We take care to ensure product information is accurate. However, minor variations in colour, size, or materials may occur.

14. Commercial Use & Resale

Products are sold for personal use or commercial accommodation use. Resale or redistribution is prohibited without our prior written consent.

15. Links to Third-Party Sites

This website may contain links to third-party sites. We are not responsible for the content or practices of those sites.

16. Termination of Accounts

We may suspend or terminate customer accounts if they misuse the site or breach these Terms.

17. Dispute Resolution

We aim to resolve disputes quickly and fairly. Please contact us in the first instance. If unresolved, disputes will be handled in accordance with Clause 10 (Governing Law).

18. Miscellaneous

Failure to enforce any part of these Terms does not waive our right to enforce them later. If any clause is found unenforceable, the remaining clauses remain in effect. We may assign or subcontract obligations under these Terms without notice. Customers may not assign rights without our consent.

 



Quick Terms (Plain English)

  • Pricing & Currency: Prices shown in NZD (NZ) or AUD (AU). GST included (15% in NZ, 10% in AU). Shipping added at checkout.
  • Payment: Pay in full before dispatch (unless trade account). Credit/debit cards accepted.
  • Shipping & Delivery: NZ and AU wide. Delivery times vary. Unreasonable delays may entitle refund/replacement under law.
  • Returns: 30-day returns on unused, unopened, resalable items. Opened bedding not returnable unless faulty. Faulty items repaired, replaced, or refunded.
  • Warranty: Covers manufacturing defects. Misuse, wear and tear, or ignoring care instructions not covered.
  • Your Rights: Protected by NZ Consumer Guarantees Act and AU Consumer Law. These rights cannot be excluded.
  • Liability: Limited to fixing, replacing, or refunding the product. Not liable for indirect losses (e.g., lost profits).
  • Privacy: We respect your privacy and follow our Privacy Policy.
  • Commercial Use: Bedding for personal or accommodation use only. Resale needs consent.
  • Disputes: Contact us first. If unresolved, disputes handled under NZ law (AU rights also apply).
